Hailing from Flagler County, Kerouac is seeking over $50,000 (Rs 4,159,500) in damages from Dunkin Donuts in a lawsuit filed more than a year after a startling incident involving an exploding toilet. He claims to have suffered severe and long-term injuries, both physical and psychological, as a result of the toilet mishap that occurred at a Dunkin’ location in Winter Park on January 6, 2022.
According to the complaint filed in state court and obtained by PEOPLE, Kerouac found himself in a distressing situation when a toilet in the men’s room of the Dunkin’ exploded, leaving him covered in debris, including human faeces and urine. The court filing alleges that Dunkin’ employees were aware of previous incidents involving the same toilet but failed to address the issue or warn customers like Kerouac.
The lawsuit argues that Dunkin’ had a duty to warn customers about the potential hazard posed by the malfunctioning toilet but neglected to do so. Additionally, Dunkin’ is accused of failing to adequately maintain and inspect the toilet, contributing to the unfortunate incident. When contacted for comment by PEOPLE, Dunkin’ responded by stating that it does not comment on litigation involving franchisees.
